TERMS AND CONDITIONS

1. Overview

These Terms and Conditions (hereinafter referred to as the "Terms") govern your access to and use of the services of Anglium Network ("Anglium" , "we" , "us", "our"). Anglium Network is a decentralised DePIN project built on the Solana blockchain that combines node infrastructure, a farming mechanism, NFT Node Pass, DAO governance and other services to form an open global network.

The services provided through Anglium include (but are not limited to):

• The official website angliumnetwork.com-user dashboard for managing nodes and viewing rewards;
• Farming programme with rewards in the form of internal points or $ANG tokens;
• NFT Node Pass – a unique mechanism for accessing network functionality.
• DAO module for voting and ecosystem management.

These Terms constitute a legal agreement between you and Anglium and govern your rights and obligations when using any network services. Please read them carefully before creating an account, using the dashboard, participating in farming, or interacting with the DAO.

By using Anglium's services, you confirm that you accept these Terms and agree to comply with them comply with them. If you do not agree with them, you must not access the services or participate in the network. participate in the network.

2. Restricted Persons; Minors

2.1. Restricted Jurisdictions.

Anglium Network services may not be accessed or used by any individual or entity that:

• Resides, is registered, or has an office in a country or jurisdiction subject to international economic or financial sanctions;
• Is located in a jurisdiction where the use of Anglium services is illegal or prohibited by applicable law;
• Is included in sanctions lists (including, but not limited to: OFAC, EU, UN, etc.).

Such persons are considered "Restricted Persons" and are not entitled to access the services or participate in the Anglium network.

2.2. Minors.

Access to Anglium services is prohibited to any persons who have not reached the age of majority in their jurisdiction of residence (hereinafter referred to as "Minors"). Use of the services by minors is a violation of these Terms.

2.3. Circumvention of restrictions.

Any attempts to circumvent these restrictions using VPNs, proxy servers or any other technological means are strictly prohibited. The use of such methods may result in immediate blocking of access to your account and Anglium services without compensation.

3. Access; Account; Wallets

3.1. Creating an account.

To use Anglium services, the user must create an account by providing the minimum required data (login, password, email or other technical data). In the future, access may also be provided through NFT Node Pass or other authentication mechanisms specified by the Anglium network.

3.2. Confidentiality of account details.

The user undertakes to keep their account details (login, password and other login information) confidential and not to disclose them to third parties. All actions performed through the user's account are considered to have been performed by the user themselves. Anglium is not responsible for any loss or damage caused by unauthorised access to the user's account.

3.3. Use of the Solana wallet.

To participate in farming, DAO or other Anglium services, the user must connect a compatible Solana wallet. The user is fully responsible for the security of their wallet, including the safekeeping of private keys, seed phrases and other means of access.

3.4. Loss of access.

In the event of loss of access to the wallet (e.g., loss of seed phrase, private key, or device compromise), Anglium has no technical ability to restore access to the wallet, restore the balance, or any accrued rewards. All losses associated with loss of access to the wallet are borne solely by the user.

3.5. Personal access.

Access to Anglium services is personal and may not be transferred or sold to others without the prior written consent of Anglium.

4. Intellectual Property

4.1. Property Rights

All intellectual property rights to the Anglium website, dashboard, design, software, logos, trademarks, NFT Node Pass, and other brand elements (hereinafter referred to as "Anglium Property") belong to the Anglium Network team or its licensors.

4.2. Restrictions on Use

The user may not copy, modify, distribute, sell, license, reproduce or otherwise use Anglium Property without the prior written permission of the Anglium team. Any unauthorised use may be considered a violation of copyright and trademark rights.

4.3. Use of logos and brand

The use of the Anglium logo, graphic materials or any elements of identity is permitted only with the written consent of the Anglium team. It is prohibited to use them in a way that may mislead users or create the impression of an official partnership without an actual agreement.

4.4. Feedback

Users may provide feedback, ideas or suggestions for improving Anglium's services. By providing such feedback, the user agrees that Anglium may freely use, integrate and implement these suggestions in its products and services without any obligation to compensate the user.

5. Code of Conduct; Restrictions

5.1. General principles.

The user agrees to use Anglium services exclusively in a lawful manner and in accordance with these Terms. Any actions that harm the network, other users or the Anglium brand are prohibited.

5.2. Prohibited Actions.

The user is prohibited from:

• engage in hacking, attacks, exploits, DDoS or other actions aimed at breaking or destabilising the network;
• manipulate the reward system (e.g., falsify traffic, uptime, IP addresses, etc.);
• use bots, scripts or automated tools unless they are provided by the official Anglium SDK;
• engage in fraudulent activities, deception, or impersonation;
• circumvent access restrictions (e.g., gain access without an NFT Node Pass or by other illegal means);
• distribute malware, viruses, or other tools that may harm Anglium services or other users' data;
• use Anglium services for purposes that are contrary to the law (e.g., to anonymise criminal activity).

5.3. Consequences of violation.

In the event of a violation, the Anglium team reserves the right to:

• temporarily or permanently block the user's account;
• cancel rewards or points obtained by dishonest means;
• forward information to the relevant authorities if the violation has signs of fraud or criminal offence.

5.4. User responsibility.

The user is solely responsible for all actions performed through their account, as well as for keeping their logins, passwords and access to their wallet secure.

6. Availability; Downtime; Updates

6.1. No guarantee of uninterrupted service.

Anglium services are provided on an "as is" and "as available" basis. We do not guarantee that access to the website, dashboard, farming or DAO will be constant, uninterrupted or error-free.

6.2. Possible failures and technical work.

From now and then, the operation of the services may be suspended due to:

• technical maintenance or updates;
• problems with servers, the Solana blockchain or partner providers;
• force majeure circumstances, including cyber attacks, equipment failures, network problems or government restrictions.

In such cases, Anglium shall not be liable for any loss or inability to access your account or rewards.

6.3. Updates and changes.

We reserve the right to change, update or delete any functionality of the Anglium services (including dashboard design, NFT Node Pass, farming mechanics) without prior notice to users.

6.4. User responsibility.

The user is solely responsible for:

• having a stable internet connection;
• the operability of their own equipment (PC, smartphone, server or other device used as a node).

Anglium is not responsible for failures arising on the user's side.

7. Disclaimers

7.1. "As is" principle.

All Anglium services (website, dashboard, farming, NFT Node Pass, DAO, and other features) are provided "as is" and "as available." We do not guarantee that the services will operate continuously, without errors, or meet user expectations.

7.2. No guarantee of profit.

No farming mechanics, rewards in $ANG tokens, or use of NFTs guarantee profit or value preservation. Results depend on the market, technical conditions, and user participation.

7.3. No investment advice.

Anglium is not a financial or investment institution. Any information on the website, in documentation or communications is not investment advice. The user must make their own decisions and, if necessary, consult with financial advisors.

7.4. Responsibility for wallets.

The user is fully responsible for the security of their Solana wallet, private keys, seed phrases, and passwords. If access is lost, recovery is not possible. Anglium does not have access to wallets and is not responsible for their security.

7.5. Legal status of NFTs and tokens.

NFT Node Pass, $ANG tokens, and farming points are not securities, investment contracts, or financial instruments. They are created solely for the purpose of accessing the functionality of the Anglium network, managing the DAO, and encouraging participation in the ecosystem.

7.6. Risks of using blockchain.

The user acknowledges that the operation of blockchain systems (including Solana) may be accompanied by technical failures, network congestion, increased fees, protocol changes, or other risks. Anglium is not responsible for the consequences of such events.

8. Assumption of Risk

8.1. Voluntary participation.

The user confirms that access to Anglium services (website, dashboard, farming, DAO, NFT Node Pass) is voluntary and at their own risk. Participation in the project is not mandatory, and the user independently makes decisions regarding interaction with the network.

8.2. Possible technical risks.

The operation of the services may be accompanied by technical failures, interruptions in access, errors in the calculation of rewards, data loss or other unforeseen problems. Anglium is not responsible for such cases.

8.3. Loss of rewards.

Farming points, $ANG tokens, and NFT Node Passes do not guarantee income. There may be cases where a user does not receive the expected reward due to technical, market, or legal factors.

8.4. Features of the Solana blockchain.

Transactions on the Solana blockchain are irreversible and public. Information that has been entered into the blockchain (e.g., transactions or staking) cannot be changed or deleted. Anglium does not control the blockchain and cannot influence its operation.

8.5. External factors.

The value of tokens, NFTs, and rewards may depend on the cryptocurrency market, regulatory changes, or the actions of third parties. Anglium does not guarantee the stability or liquidity of these assets.

9. Investigations; Enforcement

9.1. Right to investigate.

Anglium reserves the right to investigate any suspicious activity related to the use of its services (website, dashboard, farming, DAO, NFT Node Pass). This includes, but is not limited to: suspected fraud, use of bots, abuse of resources, or violation of the rules of conduct.

9.2. Suspension of access.

We may temporarily suspend or restrict a user's access to their account or nodes in the event of violations or suspected violations. The suspension may last as long as necessary to complete the investigation.

9.3. DAO decisions.

In cases involving joint network management, the DAO may decide to restrict or block individual users who have violated the rules or caused damage to the ecosystem.

9.4. Transfer of data to law enforcement agencies.

Anglium may cooperate with regulators and law enforcement agencies. In the event of legal requirements or court orders, we may disclose relevant information if necessary to comply with the law.

9.5. Disclaimer.

The user acknowledges that Anglium and DAO are not responsible for any consequences of blocking or restricting access if this was done in accordance with these Terms.

10. Limitation of Liability

10.1. No Liability for Indirect Losses.

Anglium, its team, partners, and DAO are not liable for any indirect, incidental, special, punitive, or consequential damages. This includes, but is not limited to: loss of profits, loss of data, damages due to service interruptions, decrease in the value of tokens or NFTs, inability to access your account or wallet.

10.2. Maximum compensation limit.

In cases where Anglium's liability cannot be completely excluded under applicable law, the maximum amount of compensation for damages is limited to $10 (ten US dollars). This provision applies regardless of the nature of the claim: contractual obligations, tort liability, negligence or other grounds.

10.3. User responsibility.

The user acknowledges that they are solely responsible for their actions on the Anglium network, including the security of their Solana wallet, the safekeeping of their seed phrase, and the use of NFT Node Pass or farming mechanisms.

11. Indemnification

11.1. User obligations.

The user agrees to defend, indemnify, and hold harmless Anglium Network, its team, partners, advisors, and DAO members from any claims, lawsuits, penalties, damages, expenses, or legal fees arising from the user's actions.

11.2. Reasons for Indemnification.

Indemnification may be required in cases where damages or claims arise due to:

• the user's violation of these Terms;
• fraudulent actions, hacking or manipulation;
• use of Anglium services for illegal purposes;
• harm to other users or the network (e.g., through bot attacks or unfair use of resources).

11.3. Amount of liability.

The user is obliged to compensate Anglium or DAO for the full amount of damages, including legal defence costs, incurred in connection with their actions.

12. Suspension; Termination

12.1. Grounds for suspension.

Anglium has the right to temporarily suspend or completely block a user's account in cases where:

• a violation of these Terms is detected:
• The user is suspected of fraud, manipulation, hacking or the use of bots;
• The account is used from jurisdictions where participation in the project is prohibited by law;
• the user attempts to circumvent access restrictions (e.g. by using a VPN).

12.2. Consequences of blocking.

If an account is blocked, the user:

• loses access to the dashboard, NFT Node Pass, DAO, and farming mechanics;
• loses any unregistered or unclaimed rewards;
• cannot claim compensation or reimbursement from Anglium or DAO.

12.3. Duration of suspension.

Suspension may be temporary (for the duration of the investigation) or permanent (without the right to restore the account). The decision is made by the Anglium administration or by DAO vote in cases involving the interests of the community.

13. Linked Resources (Third-party services)

13.1. Use of third-party services.

To work with Anglium, the user may use third-party services, including: Solana Wallets (Phantom, Solflare, etc.), NFT marketplaces, cryptocurrency exchanges, authorisation services, or third-party integration tools.

13.2. Independence of policies.

Each third-party service operates under its own Terms of Use and Privacy Policy. Anglium does not control and is not responsible for how such services collect, store, or use user data.

13.3. Risks for the user.

When using third-party services, the user independently assumes all risks associated with their operation (including possible failures, loss of access to the wallet, changes in rules or commissions).

13.4. No guarantees.

Anglium does not guarantee the availability, reliability or security of third-party services, even if links to them have been posted on our website or dashboard.

14. Changes to Terms

14.1. Right to change.

Anglium reserves the right to change, supplement or update these Terms at any time. Changes may be due to technical updates, project development, changes in legislation or other factors.

14.2. Publication of Updates.

The current version of the Terms will always be available on the official website angliumnetwork.com.

14.3. Entry into force.

Changes shall take effect from the moment they are published on the website, unless otherwise specified in the announcement.

14.4. Continued use.

Continued use of Anglium services after the publication of the updated Terms means that the user automatically agrees to the new version.

15. Governing Law; Dispute Resolution

15.1. Applicable law.

These Terms, as well as all relations between users and Anglium, are governed by the laws of the jurisdiction of the company/DAO's registration (e.g., the British Virgin Islands (BVI) or Estonia). In the event of clarification of the project's legal address, it is this legislation that will be considered applicable.

15.2. Place of dispute resolution.

All disputes arising in connection with the use of Anglium services (website, dashboard, NFT Node Pass, DAO, farming) shall be resolved through arbitration or the courts of the jurisdiction of the company/DAO registration.

15.3. Alternative dispute resolution methods.

Before resorting to court or arbitration, the parties agree to attempt to settle the dispute through negotiation or mediation.

15.4. Possibility of injunctive relief.

Anglium reserves the right to seek urgent measures (e.g., to protect against fraud or misuse of the network) in any jurisdiction if necessary to protect the interests of the project and its users.

16. Waiver of Class Actions

16.1. Individual Dispute Resolution.

The user agrees that any disputes, claims or lawsuits against Anglium may only be considered on an individual basis.

16.2. Prohibition of Class Actions.

No claims or arbitration proceedings may be brought as a group, class, representative or third-party action.

16.3. Waiver of Class Action.

The user expressly waives the right to participate in any class actions or consolidated lawsuits against Anglium, DAO or related parties.

16.4. Preservation of Rights.

This provision does not limit the user's right to file an individual lawsuit or arbitration in accordance with the applicable law of the chosen jurisdiction.

17. Limitation on Time to Bring Claims

17.1. Time to Bring Claims.

Any claims, disputes or lawsuits arising from or related to the use of Anglium's services must be filed no later than one (1) year from the date the user knew or should have known about the basis for such a claim.

17.2. Missed Deadline.

After this period, the user irrevocably loses the right to file a claim, regardless of whether they were aware of their rights earlier.

17.3. Exceptions.

The limitation period shall not apply in cases where it is expressly prohibited by the applicable law of the chosen jurisdiction.

18. Entire Agreement

18.1. Single document.

These Terms (together with the Privacy Policy and any additional rules or programmes that may be published on the Anglium website) constitute the entire and exclusive agreement between you and Anglium Network.

18.2. Prior agreements.

All prior oral or written agreements, proposals, statements and discussions regarding the use of Anglium services shall cease to be valid upon the entry into force of these Terms.

18.3. No Third Party Agreements.

No additional terms or obligations shall be deemed valid unless they are set forth in writing and agreed to by Anglium Network.

19. No Waiver

19.1. Failure to exercise rights.

If Anglium Network does not take action in response to a breach of these Terms immediately, this does not constitute a waiver of our rights.

19.2. Continued Application.

We reserve the right to enforce the provisions of these Terms at any time in the future.

20. Severability

20.1. Invalidity of individual provisions.

If any provision of these Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction or arbitration, this shall not affect the validity and enforceability of the remaining provisions.

20.2. Replacement of invalid provisions.

If any provision is found to be invalid, it may be replaced by another provision that most closely reflects the original intent and spirit of these Terms.

21. Assignment

21.1. Prohibition for users.

Users may not assign their rights or obligations under these Terms to third parties without the prior written consent of Anglium.

21.2. Anglium's right.

Anglium reserves the right to assign or delegate its rights and obligations under these Terms to any third party (e.g., in the event of a partnership, restructuring or transfer of assets).
